Which US state should I set up residency in?

Iโ€™m trying to decide which US state to set up residence in.

This is a complicated question. For one thing, deciding where you want to reside depends on things like:

  • Income Tax (None in FL, TX, NV, WA, SD, TN (excpt dvnds)
  • Sales Tax (especially for vehicles)
  • Property Tax
  • Health Insurance rules for those who arenโ€™t in-state much

And requirements like:

  • How long do you have to be in-state?
  • How often do you have to renew Driverโ€™s License and Registration?
  • Can you get out of jury duty because youโ€™re gone?

And there are some new complications:

The Patriot Act now requires that financial institutions have a residential address on file for each of their customers, and it explicitly excludes the use of mail forwarding addresses for this purpose.

So I wanted to start a thread that gathers some good information on how people make this decision, problems theyโ€™ve had, and things theyโ€™ve learned.

For me it might make sense to stay in FL because itโ€™s tax-free, I have the license already, and they have no in-state requirement. But I have no family or real address there if itโ€™s ever required, and I donโ€™t see myself owning land there because itโ€™s too far from a major airport.

Nevada or TX makes sense if Iโ€™m going to buy some land and stay in the wintersโ€“both are by good airports and have strong tech communities.

Maybe folks want to contribute to a spreadsheet that has some of this data filled in? Or we can keep it in this thread?

For most of us that are earning right now, the short list is probably the states with no income tax, but there are other considerations and I want to make sure we know what weโ€™re getting in to.

How have you all made this decision?

I did some research on Puerto Rico and went thereโ€ฆ I was thinking about moving there for tax reasons. If you have investments in the US it wonโ€™t really countโ€ฆ youโ€™ll need investments in other parts of the world or puerto rico to get the zero tax on capital gains and dividendsโ€ฆ and as far as incomeโ€ฆ if you are in puerto rico and most of your clients are in the USโ€ฆ this wonโ€™t count ( I believeโ€ฆ not completely sure on this one) โ€ฆ I know for sure if you have any form of address in the US it wonโ€™t count. Honestlyโ€ฆ the tax incentive are hugeโ€ฆ but living in puerto rico is not what I want to doโ€ฆ you can still save a lot but in a different way by going to places with low coast of livingโ€ฆ yea, youโ€™ll still get taxed wherever you are in the world as an American citizenโ€ฆ but if your cost of living is so ridiculously low it wonโ€™t matterโ€ฆ

One thing I havenโ€™t seen mentioned is the link between state residency and business franchise fee structure. Especially if you plan to operate several businesses, this can get very expensive. From experience I know that California has things set up where it is very difficult to avoid their yearly franchise tax fees ($800 minimum) for both LLCs and Corporations, whether your entity is formed in state or out of state if you are a resident. I imagine a similar situation exists in other high tax states, but possibly even in no income tax states with high franchise fees.

Actually, Washington state has no tax on individuals but does have a tax on businesses. It is called the B&O tax which is a gross receipts tax and is the reason I chose not to form a business there.

BTW, California does have a similar deal to the FEIE which is called โ€œsafe harborโ€. Major difference is they have a 546 day time window to be out of the USA vs the FEIE which operates on a 365 day window. There is also a 200K limit on intangible income which might nail you if you have lots of investments or certain royalties, etc.

I set up a Seattle mailbox with Traveling Mailbox. It is a real address, not a PO box, so I havenโ€™t had any issues plus WA state doesnโ€™t have income tax or businesses or individuals. Was even able to get a drivers licenses with my mailbox.

Curious to hear about peoplesโ€™ experiences with Patriot Act address verification.

Weโ€™ve had residency in TX for some time now with our only address being a mail forwarding address and are starting to run into problems with our banks.

Has anyone figured out a way to get around this, or had experience dealing with financial institutions regarding the Patriot Act?

Yes, I too have been receiving notices from banks recently re address verification. Quite annoying. I have been with these banks many years too - so not sure what triggered the need for new verification. They are requesting a utility bill. Causing a huge headacheโ€ฆ likely to lose that account. Sucks that the Patriot Act is causing legitimate US citizens who pay US Federal & State taxes to lose bank accounts. We arenโ€™t doing anything wrong but are caught up in their net. Very annoying.

Sounds interesting. Have you done this? Know an article thatโ€™s a first-person account of the process? I see a lot of โ€œPuerto Rico is a Tax Havenโ€ summary articles, but nothing practical.

It also looks like a break on income derived from Puerto Rican sources, as well as capital gains and dividends earned after being a resident. Residents must live in the territory 50% of the year. Am I missing something useful?

I donโ€™t believe that to be true. Tax liability varies by state and not all states recognize FEIE, itโ€™s at the federal level.

if you qualify for the FEIE it doesnโ€™t matter what state youโ€™re in. My mail gets sent to my mom in Indiana. My DL is from AZ because thatโ€™s where I lived when I last owned a car. Iโ€™ve not changed it because Iโ€™ve not owned a car since 2001 (havenโ€™t lived in AZ since then either) and it doesnโ€™t expire until Iโ€™m 65.

I didnโ€™t realize that this is probably true. For most people, your state of residence doesnโ€™t matter. For California though (and maybe others), it is very difficult to move away, and the Foreign Earned Income Exemption is irrelevant. Donโ€™t want this to take anyone by surprise. Itโ€™s a shady move on Californiaโ€™s Franchise Tax Boardโ€™s part and they donโ€™t deserve extra money for it.

How to get SMS verifications for banks while traveling?

Any suggestions for seamlessly receiving SMS Verifications from US financial institutions and other sites while traveling internationally continuously? Wonโ€™t keep my US Verizon account due to cost and currently plan to use local sims at each destination (T-Mobile and Project Fi are NOT an option as they terminate for continuous roaming). In summation, I wonโ€™t have a US mobile account.

Unless Iโ€™m missing something, which is very possible, this appears to be the single most complex issue Iโ€™ve encountered in my preparations, and one that no one addresses. I would greatly appreciate any possible solution that works 100% of the time. Canโ€™t afford surprises in this regard. Many Thanks! Jack.

We must all get sick of the same backpacker travel questions when we meet new friends, I know I do.

Best Place in South East Asia to stay for 6 months+ (Tax purposes)

We're looking for a country in south east asia that can function as our base, mainly for tax purposes. Meaning it will have to be a place where we can stay for the 183 days required without too much hassle.

We've been looking at Thailand, but have heard that it's very hard to do visa runs etc., so what other can you recommend? Indonesia looked like a good option, but the income rate is a flat 20% and very high for the region.

I'm thinking about taking a sailing (yachting) course in the Mediterranean Sea this coming September or October. Thus far from my research, it seems that most courses are held in locations with not many digital nomads. My thinking is that it would be more fun to go to a place with like-minded people. How to get a UK residence address without renting/buying?

Background:
Iโ€™m an EU national IT specialist, recently decided to become a digital nomad. I just left my permanent job in Germany and opened a UK based LTD (for a better taxation) to start a new career as remote working IT contractor. I also want to become a UK resident and pay personal income tax there BUT I donโ€™t want to rent/buy a place because I have no interest in physically living in the UK, as a nomad I will be traveling abroad 100% of the time.

So I just need a UK address where Iโ€™m registered as a resident and could receive mail, but I would never actually be there. I could rent a place and keep it empty but that would be a total waste of money.

Question:
How do I find somebody who could give me an official residence at his/her address and keep my name on the door? Iโ€™m ok with paying a reasonable monthly fee for this โ€œserviceโ€ (but not as high as a rent), and give assurance in whatever form that I will never pretend to physically live there. I have no close friends in the UK to ask for this favor, and trying to propose this to a random landlord would be just weird since they are not familiar with the needs of a digital nomad.

Maybe you guys can suggest me somebody who understand the situation and want to make some extra cash every month to pay the bills? Iโ€™m ready to meet in person, provide full proof of identity or any other document, and to make a written agreement that gives the landlord the freedom to cancel this โ€œsituationโ€ at any time.

Note:
This is NOT for tax evasion, itโ€™s the opposite! I WANT to pay full tax as UK resident, I just donโ€™t want to waste money on a rent which I will literally never use.

I would be very grateful for any advice!

How does Ireland tourist visa length and recurrence work?

Iโ€™m planning a stint in Ireland and Iโ€™m wondering about the 90-day tourist visa. Official information just mentions the 90-day limit without elaboration. Is it akin to Schengen where itโ€™s counted against the most recent 180-day period? Iโ€™m asking because I might like to take trips to the continent flying out of Dublin, but I donโ€™t know how I should account for the days Iโ€™m gone if I do that. Do I stop the 90-day clock for Ireland while Iโ€™m away, or should I make sure Iโ€™m gone from Ireland <= 90 days after my initial arrival date, regardless of where else I go during that interval, just to be safe? What have others done?
